THE RIGHT TO LIFE OF THE UNBIRTH
Victimological Analysis and Ethical-Legal Implications

The present study examines the right to life of the unborn child from the perspective of victimology, focusing on the ethical and legal challenges involving the protection of the unborn child and women's reproductive autonomy. The research adopts a legal-dogmatic approach, combining a systematic bibliographical review and analysis of paradigmatic cases from higher courts in Brazil and internationally. The results indicate that the application of victimology to the unborn child reveals unique vulnerabilities, including normative gaps and inconsistencies in the interpretation of the right to life. It is concluded that the use of an interdisciplinary approach can contribute to a fairer balance between conflicting rights and to the formulation of inclusive and legally robust public policies.
